Documentation Terms of Use

These Documentation Terms of Use (these “Terms”) govern access to and use of the FieldHub documentation site and its contents — including user guides, articles, release notes, screenshots, transcripts, and other instructional content (collectively, the “Documentation”) — provided by FieldHub Inc. ("FieldHub," “we,” “us”).

1. Acceptance

By checking the acceptance box, submitting your email address, and clicking the emailed verification link, you agree to these Terms on behalf of yourself and, if you access the Documentation in the course of your work, the organization you represent ("you"). If you do not agree, do not access the Documentation. We record the email address, time, and Terms version of each acceptance.

2. Relationship to the Subscriber Agreement

If you or your organization has an agreement with FieldHub governing use of FieldHub’s services — including the FieldHub Subscriber Terms of Service or a predecessor subscription agreement (each, a “Subscriber Agreement”) — these Terms supplement that agreement with respect to the Documentation and do not amend it. In the event of a conflict, the Subscriber Agreement controls. These Terms apply in full to access by anyone not covered by a Subscriber Agreement.

3. License

Subject to these Terms, FieldHub grants you a limited, non-exclusive, non-transferable, revocable license to access and view the Documentation solely for your internal business purposes in connection with evaluating or using FieldHub’s services as a current or prospective customer. No other use is licensed. All rights not expressly granted are reserved.

4. Restrictions

You will not, and will not permit or assist anyone else to:

1. copy, republish, distribute, sell, or make the Documentation available to anyone outside your organization;
2. scrape, crawl, spider, harvest, bulk download, or access the Documentation by any automated means;
3. use the Documentation, in whole or in part, to train, fine-tune, ground, augment, or otherwise develop any artificial-intelligence or machine-learning model, system, or dataset (including large language models), whether directly or through a third party;
4. use the Documentation to reverse engineer FieldHub’s products or services, or to design, build, assist, or inform a product or service that competes with FieldHub;
5. share, transfer, or make available your access, verification links, or credentials to any person outside your organization;
6. remove, obscure, or alter any copyright, trademark, or other proprietary notice; or
7. use the Documentation in violation of any applicable law or any third party’s rights.

5. Ownership

The Documentation is the copyrighted and proprietary material of FieldHub and constitutes FieldHub intellectual property. For customers under a Subscriber Agreement, the Documentation may also constitute FieldHub Confidential Information as defined there. Nothing in these Terms transfers any ownership interest to you.

6. Access

Access requires verification of a valid email address and may be suspended or revoked by FieldHub at any time, with or without cause or notice. FieldHub does not commit to any availability of the Documentation site and may modify, move, or remove content at any time.

7. Disclaimers

THE DOCUMENTATION IS PROVIDED “AS IS” AND “AS AVAILABLE,” MAY CONTAIN ERRORS OR DESCRIBE FUNCTIONALITY THAT HAS CHANGED, AND DOES NOT CONSTITUTE A WARRANTY, CONTRACTUAL SPECIFICATION, OR COMMITMENT OF ANY KIND. THE FEATURES AND PERFORMANCE OF FIELDHUB’S SERVICES ARE GOVERNED EXCLUSIVELY BY THE APPLICABLE SUBSCRIBER AGREEMENT. FIELDHUB DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FIELDHUB WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM ACCESS TO OR USE OF THE DOCUMENTATION, AND FIELDHUB’S TOTAL LIABILITY UNDER THESE TERMS WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS (US $100).

9. Termination and Survival

The license in Section 3 ends automatically upon revocation of your access, termination of your (or your organization’s) customer relationship with FieldHub, or your breach of these Terms. Sections 4, 5, 7, 8, 9, and 10 survive termination.

10. General

Breach of Section 4 would cause FieldHub irreparable harm for which damages are an inadequate remedy; FieldHub is entitled to seek injunctive relief in addition to all other remedies. FieldHub may update these Terms by posting a revised version with a new version number; continued access after a revision takes effect constitutes acceptance. These Terms are governed by the laws of the State of Delaware, without regard to conflict-of-law rules, and any action must be brought exclusively in the federal or state courts located in Claymont, Delaware. Personal information collected in connection with Documentation access is handled per FieldHub’s Privacy Policy.
